Terms of Service
These Terms of Service ("Terms") govern your access to and use of tract.earth — the Massachusetts real-estate research platform and Deal Desk CRM operated by Engine.Earth ("tract.earth", "we", "us"). By creating an account or using the service, you agree to these Terms.
1. Agreement to these terms
By accessing or using tract.earth (the "Service"), you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference. If you use the Service on behalf of a brokerage or other organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
If you do not agree to these Terms, do not use the Service.
2. The service
tract.earth provides research and workflow tools for Massachusetts real estate, including:
- Parcel and assessor data for Massachusetts municipalities, built on MassGIS L3 canonical parcels and public assessor records;
- Owner and entity ("LLC/Trust") intelligence, comparable sales, zoning references, and distress signals such as tax delinquency, pre-foreclosure, and lis pendens;
- Owner skip-trace enrichment, USPS-certified direct mail, and the Deal Desk CRM (contacts, deals, pipelines, tasks, projects);
- Optional live MLS listings, which load only when you connect your own MLS subscription (see "MLS and third-party data"); and
- A read-only developer API to the same underlying data.
The Service is provided for lawful real-estate research, marketing, and transaction workflows. We may add, change, or remove features at any time.
3. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account.
Notify us promptly at support@earthengine.io if you suspect unauthorized use of your account. We use Supabase for authentication; you are responsible for the security of the email account and any single sign-on provider you use to access tract.earth.
4. Subscriptions, credits, and billing
tract.earth offers a free tier and paid subscription plans. Paid plans are billed in advance on a recurring basis (monthly, unless stated otherwise) through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method on each renewal until you cancel.
Credits
Certain features consume per-action credits — for example skip traces, direct-mail pieces, and property reports. Paid plans include a monthly credit allowance that resets at the start of each billing period and does not roll over. Purchased top-up credits do not expire while your account is in good standing. Credits have no cash value, are non-refundable, and are not transferable except as part of a brokerage plan you administer.
Cancellation and refunds
You may cancel at any time from the billing portal; cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods, unused credits, or downgrades.
Price changes
We may change plan prices or credit allowances. We will give reasonable advance notice of changes that affect a recurring charge, and changes take effect on your next renewal.
5. Acceptable use
You agree not to:
- Scrape, crawl, bulk-download, or systematically extract data from the Service except through the API within your plan limits;
- Resell, sublicense, or redistribute data obtained from the Service, or use it to build or train a competing dataset or product;
- Use the Service to violate any law, or any third-party right, including privacy, publicity, intellectual-property, fair-housing, telemarketing, or anti-spam laws;
- Circumvent usage limits, credit metering, authentication, or access controls, or share a single-seat account across multiple users;
- Upload malware, probe or disrupt the Service, or attempt to access accounts or data that are not yours.
We may suspend or terminate accounts that violate this section, and may impose reasonable rate limits to protect the Service and our data providers.
6. MLS and third-party data
Live MLS listings are licensed data. tract.earth displays MLS listings only when you connect your own MLS subscription credentials (for example an MLS PIN account provisioned through Bridge Data Output). Your use of MLS data is governed by your agreement with your MLS and its rules, including any IDX/VOW display and attribution requirements. You are solely responsible for holding a valid MLS subscription and for complying with those rules; we do not grant you any right to MLS data.
Other data in the Service — assessor records, MassGIS parcels, recorded documents, and similar — derives from public and licensed sources. We present it for convenience and do not guarantee it is current, complete, or free of error. It is not a substitute for the official record, a title search, a survey, or professional advice.
7. Skip trace, contact data, and outreach
Skip-trace results (owner names, phone numbers, email and mailing addresses) are provided for legitimate real-estate purposes such as contacting a property owner. tract.earth is NOT a consumer reporting agency, and skip-trace data is not a "consumer report" under the Fair Credit Reporting Act (FCRA). You may not use skip-trace data, or any contact data from the Service, for any FCRA-regulated purpose — including decisions about credit, insurance, employment, or housing eligibility.
When you contact property owners — by phone, text, email, or mail — you are the sender and you are solely responsible for complying with applicable laws, including the Telephone Consumer Protection Act (TCPA), state and federal Do-Not-Call rules, CAN-SPAM, and fair-housing laws. Direct mail is dispatched through our mail provider on your instruction and at your direction; you are responsible for the content and legality of what you send.
8. Intellectual property
The Service, including its software, design, and compiled data presentations, is owned by or licensed to Engine.Earth and is protected by intellectual-property laws. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own real-estate business. We reserve all rights not expressly granted.
You retain ownership of the content you create in the Service (for example CRM contacts, deals, notes, and uploads). You grant us a license to host, process, and display that content solely to operate and improve the Service.
9. Disclaimers
THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that any data is accurate, current, or complete. Real-estate decisions are yours; verify against official records and qualified professionals before acting.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ENGINE.EARTH AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.
11. Indemnification
You will indemnify and hold harmless Engine.Earth from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, your outreach to property owners, or your violation of these Terms or of any law or third-party right.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law or by a data provider, or to protect the Service. On termination, your right to use the Service ends; sections that by their nature should survive (including IP, disclaimers, liability limits, and indemnity) will survive.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date, and where appropriate we will provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws rules. The state and federal courts located in Massachusetts will have exclusive jurisdiction over disputes, and you consent to their jurisdiction and venue.
